These terms and conditions regulate access and use to the website, as well as products order.

Please note the terms and conditions can be adapted and/or modified at any time. If you do not accept them, please refrain from using the website and its content.

Modifications in the information contained in the website
Moanne reserves the right to change, delete or update the information included in the website, catalog, price list, or any other document at any time, without giving prior notice.

Intellectual property
All copyright over designs, databases and software (including source codes), as well as all the elements contained in the website (texts, graphics, photos, videos, colours combinations (content), and its structure, selection and organization, are owned by Moanne.

Personal data protection
In accordance with the law on protection of personal data currently in force, Moanne hereby informs that all the personal data provided by the user or accessed by font advocats within users’ browsing, queries and/or applications through the website will be included on a file owned by Moanne, for the purpose of managing, keeping and controlling your information requirements and to receive commercial communications (also by electronic means). Users’ acceptance of information being sent to him/her can be revoked at any time, without retroactive effects, by sending us e-mail at info@moanne.com

The user may exercise his/her rights to access, rectify, terminate and oppose the processing of data in the registered address of Moanne.

Internet Policy 
Dealer internet websites may neither advertise, nor in any way, display the Moanne name, logo, product images or any other proprietary company emblems or information without prior written consent from the company. Dealer websites may not display pricing lower than Moanne, promotional offers, discounts or value statements. Check our Privacy Policy for more.

Order Terms
By placing an order it is implied that you accept our terms and conditions
Pro-forma orders will require a 50% deposit with the order and the balance prior to shipping from our warehouse. After the first deposit is made, any change to the pro forma will be impossible to perform. Please check and approve all data on the pro forma before making any deposit. Moanne is not responsible for the impossibility of any changes to this document. All pieces are the property of Moanne until payment in full is received. Moanne reserve the right to defer the dispatch date until the balance of the order is received.

The customer must make each payment via bank transfer as indicated on the proforma invoice.
It is also advised to send proof of the bank transfer to Moanne.

Product Standards 
Each Moanne design is handcrafted. While every effort is made to maintain uniformity, slight variations may occur.

We reflect product colours as accurately as possible. However, due to differences in monitors, screen sizes and resolutions, we are unable to guarantee that the colour you will see on your display or monitor will accurately reflect the true colour of the product. All measurements quoted are approximate and the reproduction of colours is as accurate as photographic and publishing processes will allow.

Moanne has the ability to customize existing products or new products to meet contract specifications. These orders will necessitate special pricing based on quantity and features. Please contact Moanne for contract quotes.

We reserve the right, without prior notice, to discontinue products or change specifications and prices on products. Prices always refer to one unit and are Exworks Spain.
Transport cost is paid by the client.

Lead Times
Production time is between 6 to 9 weeks. Delivery time is not included. For pieces with custom specifications or orders of large quantities we reserve the right to agree with the customer on a time of delivery. The lead time for this custom orders can vary between 12 and 24 weeks.

All quoted completion and delivery dates are estimates only. Moanne shall not be liable for delays in completion or shipment or default in delivery for any reason of force majeure or for any cause beyond Moanne’s reasonable control. 
In the event of any delay in Moanne’s performance due in whole or in part to any cause beyond Moanne’s reasonable control, Moanne shall have such additional time for performance as may be reasonably necessary under the circumstances. Acceptance by Buyer of any goods shall constitute a waiver by Buyer of any claim for damages on account of any delay in delivery of such goods.

Order Cancellation  
Merchandise is manufactured upon the receipt of the order and deposit. Cancellations will not be accepted after 2 working days from the order issue date. A 50% restocking fee will be applied to any cancellations received after the order issue date.

Storage Fees 
From the date of balance payment request, Moanne will reserve the right to invoice the client for any period longer than one month of stocking the orders. For each period of 30 days, Moanne will invoice the client with a 10% restocking fee.

Return Authorization 
No returns will be accepted without written consent from Moanne. Unauthorized returns will be refused at the customer’s expense.

If a problem arises, Moanne reserves the right to determine whether return or repair is more appropriate. In case of replacement, it is an essential requirement to deliver the damaged part to receive a new one.

Collect by the carrier of the customer’s choice unless otherwise stated on the order. Transport quotations provided by Moanne don’t include unforeseen expenses such as local customs clearance, even for door to door deliveries.

Freight policy & Damage claims
Title passes to the purchaser at the time the goods are picked up by the carrier in our warehouse. All products are carefully packed and inspected prior to shipment. 

We are not responsible for loss or damage in transit. If a visible or concealed damage occurs in transit, please notify immediately the delivering carrier with a file notification of claim intention.
The original packaging of the products must be kept. In case a claim is submitted, the packaging must be kept during the period in which the claim is settled.
If the collection or return of any item is needed and the original packaging was not kept, the client shall be responsible for all costs and procedures necessary for the item to be in shipping conditions. 

Moanne reserves the right to decline responsibility if: a. The claim is presented after the 2 working day period, or is not accompanied by the mandatory information mentioned in 5 working days; b. The claimed products were altered out or any way tempered with, either by the client or by a third party, without Moanne’s consent; c. The products show clear signs of regular use.

Please note: Any damage should also be communicated to Moanne during the first 48 hours after receiving the order; photographic evidence of the damages should be sent by email to sales@moanne.com.
